Zero Tolerance Policy

State and Federal legislation and local Board Policy require our school district to expel any student who commits one of the following four acts during school hours, while going to or from School, or while at a school activity:

  1. Possesses a firearm. (48900b)
  2. Brandishes or uses a knife in a threatening manner. (48900b)
  3. Sells, uses or possesses any controlled substance. (48900c)
  4. Commits or attempts to commit sexual assault or commits sexual battery. (48900n)

Other Offenses for which a Student Shall be referred to board of Education for Expulsion Decision

In an effort to maintain safe and orderly schools, students shall be recommended for expulsion for the following acts, unless the principal or superintendent finds, and reports in writing that expulsion is inappropriate due to partcular circumstances:

  • intentionally cause serious injury to another person. (48900a)
  • commit assault or battery upon any school employee. (48900a)
  • offer, arrange for, or negotiate to sell any controlled substance, alcoholic beverage or intoxicant and then sell, deliver or furnish a "look-alike" substance and represent it as a controlled substance, alcoholic beverage or intoxicant. (48900d)
  • possess, sell or furnish a dangerous object, including knives, toy guns, or other objects that could be perceived as or used as a weapon. (48900b)
  • commit acts of hate violence or repeated harassment and intimidation. (48900.2.3.4)
  • commit acts of robbery or extortion. (48900e)
  • repeatedly commit other Education Code 48900 offenses that disrupt the educational program or cause a danger to self or others.

The Governing Board makes the final decision on all expulsion recommendations. Certain infractions must be reported to law enforcement. Law enforcement officials may interview students on campus. Every effort will be made to notify parents when this occurs.
